Terms of Service

These Terms of Service (the “Terms”) are a contract between you and the operator of SocialTV (“SocialTV”, “we”, “us”). By creating an account, ticking the “I agree” box at signup, or using the service, you accept these Terms and our Privacy Policy. If you use the service on behalf of a company, you confirm you have authority to bind that company, and “you” means the company.

If you do not agree, do not use the service. You must be at least 18 years old, or the age of majority where you live, to open an account.

SocialTV is a browser-based live production studio. It lets you create rooms, invite remote guests to appear on camera, arrange participants, screen shares and media into scenes, add lower thirds, and, on plans that include it, record the program output and stream it to third-party RTMP destinations such as YouTube or Twitch.

The service is provided as software-as-a-service. We may add, change or remove features over time (see section 14). Some features depend on your browser and device: we support current versions of Chrome, Edge, Firefox and Safari on desktop, and current mobile browsers for guests.

• You must give accurate information at signup and keep it current. One person may not hold accounts for the purpose of evading plan limits.
• You are responsible for everything that happens under your account and workspace, including the actions of team members you invite and the guests you admit to rooms. Keep your password and room PINs confidential and tell us promptly at support@socialtv.cc if you suspect unauthorised access.
• Workspace owners and admins can add and remove members, change plans and delete the workspace. Deleting a workspace permanently removes its rooms, media and recordings after the retention period described in the Privacy Policy.
• Signing in with Google creates or links an account using the email address Google provides. Google’s own terms apply to that sign-in.

Guests join a room with a link and PIN and do not need an account. When you invite guests, you are responsible for telling them that the session may be recorded or streamed and for obtaining any consent that the law where you or they are located requires. Many jurisdictions require the consent of every participant before a conversation is recorded.

Guests’ camera, microphone and screen-share media is transmitted through our media servers only for the purpose of producing your show. We do not use it for any other purpose. Guests can leave at any time by closing the page; the director can mute or remove them.

• Self-serve plans are billed monthly in US dollars, in advance, per workspace. Current prices are on the pricing page (from $29/month at the date above). The Network plan is arranged by agreement.
• New self-serve subscriptions start with a 14-day free trial. A valid payment method is collected at signup through Stripe. You are charged automatically when the trial ends unless you cancel before then from Billing settings.
• Upgrades take effect immediately and are prorated for the remainder of the current billing period. Downgrades take effect at the end of the current period and can be scheduled only when current usage fits the target plan's limits.
• Payments are processed by Stripe; we do not store card numbers. If a payment fails we will notify you and retry. If it still fails, the workspace is placed in a restricted state where existing content is kept but new shows cannot be started, and it may be cancelled after a further notice period.
• Fees are non-refundable except where the law requires otherwise or where we say so in writing. Taxes are added where applicable.
• Plan limits (rooms, participants, storage, recording and streaming hours) are enforced by the service. Recording and streaming hours reset monthly and do not roll over.

You keep all rights to the content you and your guests create with the service: video, audio, uploaded media, scene designs, recordings and streams (“Your Content”). You grant us a limited, worldwide, non-exclusive licence to host, transmit, process, store and display Your Content solely to operate the service for you and as described in the Privacy Policy. That licence ends when Your Content is deleted, subject to backups being cycled out.

You confirm that you have the rights needed for Your Content, including music, images and footage you upload, and the permission of the people who appear in it. You are the controller of personal data in Your Content; we process it on your instructions as described in our data processing terms (section 8 of the Privacy Policy).

Recordings are stored in your workspace until you delete them, you delete the workspace, or the subscription ends and the retention period lapses. Download anything you want to keep before then.

You agree not to use the service to:

• record, stream or distribute content that is unlawful, infringes someone else’s rights, is sexually explicit involving minors, or harasses, threatens or incites violence against people;
• record or stream people without the notice and consent the law requires;
• probe, scan, overload, or interfere with the service, its media servers, or other customers’ rooms, or bypass PINs, plan limits or security controls;
• resell or white-label the service without a written agreement, or use it to build a competing product by copying its features;
• upload malware or content designed to damage devices or data.

We may remove content or suspend rooms that we reasonably believe break these rules, and we will tell you when we do unless the law prevents it.

The service relies on third-party providers, including Stripe for payments, Cloudflare R2 for media and recording storage, Google for optional sign-in, Resend for transactional email, Sentry for error reporting, and our hosting provider for servers. Their availability and terms affect the service. Streaming destinations (YouTube, Twitch, Facebook and others) are governed by their own terms; you are responsible for complying with them.

We aim to keep the service available around the clock but do not guarantee uninterrupted operation. Live video depends on your network, your guests’ networks and the browsers involved. We may perform maintenance, ideally with notice for planned work. Support is available by email at support@socialtv.cc; response targets, where offered, are described on the pricing page or in your agreement.

You can cancel at any time from Billing settings; the subscription ends at the close of the current billing period and no further charges are made. You can delete your workspace from account settings, which removes Your Content after the retention period.

We may suspend or terminate your access if you materially breach these Terms, if payment fails after notice, if required by law, or if continuing would create a security or legal risk. Where practical we give notice and a chance to fix the problem first. Sections 6, 11, 12, 13 and 15 survive termination.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECORDINGS OR STREAMS WILL BE COMPLETE OR ERROR-FREE; RUN A TEST SHOW AND KEEP YOUR OWN BACKUP RECORDING FOR ANYTHING IRREPLACEABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF THESE TERMS OR THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE FEES YOU PAID US IN THAT PERIOD. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR FRAUD OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

You will defend and indemnify us against third-party claims, and the reasonable costs of them, that arise from Your Content, your guests, or your breach of these Terms, including claims that a recording or stream was made without the required consent.

We may change these Terms. For material changes we will email the workspace owner and show a notice in the app at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. Continuing to use the service after the effective date means you accept the new Terms. We may also change or retire features; if a change materially reduces what your paid plan includes, you may cancel and receive a pro-rata refund for the unused period.

[For legal review: jurisdiction, venue and any arbitration or consumer-law carve-outs to be confirmed by counsel before the effective date.] Until then, these Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction, except that consumers keep any mandatory protections of the country where they live.
